These Terms of Service, together with any policies referenced in this document, govern your access to and use of Super Minty, including our website, tools, pricing data, collection tracking features, content, community features, and any other services we may offer now or in the future.

By accessing or using Super Minty, you agree to be bound by these Terms. If you do not agree to these Terms, you should not access or use Super Minty.

1. Description of Services

Super Minty is a free-to-use video game price guide and collection tool designed to help collectors better understand the market for collectible video games.

Super Minty may allow users to view current and historic video game pricing data, compare format-based and condition-aware values, review sales history, track video game collections, research different formats and conditions, and access related educational content.

Super Minty is not an appraisal service, grading company, authentication company, financial advisor, investment advisor, auction house, or marketplace.

2. Acceptance of Terms

By accessing or using Super Minty, you represent and agree that:

• You have read, understood, and agree to these Terms;
• You will comply with these Terms and any additional policies we publish;
• You are legally able to enter into these Terms, or you have permission from a parent or legal guardian;
• You will not use Super Minty for any unlawful, fraudulent, harmful, abusive, or unauthorized purpose;
• We have not previously suspended or disabled your account for violating these Terms or our policies.

Your continued use of Super Minty after any updates to these Terms means you accept the updated Terms.

3. Free-to-Use Service

Super Minty is currently offered as a free-to-use service.

We do not currently charge users for access to the website, price guide, collection tracker, or standard account features.

Because Super Minty is currently free, there are no paid memberships, subscription fees, payment terms, or refund policies associated with standard user access.

We reserve the right to add, remove, modify, limit, or change features at any time. If we introduce paid features, subscriptions, memberships, premium tools, or other paid services in the future, we may update these Terms and provide any additional terms that apply.

4. Accounts and Security

Some features of Super Minty may require you to create an account.

When creating and maintaining an account, you agree to provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your login information and for all activity that occurs under your account.

You agree not to:

• Use false, misleading, or inaccurate account information;
• Create duplicate, fake, or fraudulent accounts;
• Share your password with others;
• Use another person's account without permission;
• Attempt to access restricted areas of Super Minty;
• Interfere with the security or operation of the website.

We reserve the right to suspend, restrict, or terminate accounts that violate these Terms, provide inaccurate information, abuse the Services, or create risk for Super Minty or its users.

5. Permitted Use

You may use Super Minty for lawful, personal, non-commercial, collector-related purposes.

You may use Super Minty to research video game values, compare format-based and condition-aware pricing, review market information, track your collection, and access educational content.

Any commercial use, resale, republication, redistribution, data extraction, automated collection, or competing use of Super Minty data requires our prior written permission.

6. Prohibited Use

You agree not to misuse Super Minty or use the Services in any way that could harm Super Minty, its users, its systems, or the collectible gaming community.

You agree not to:

• Copy, scrape, harvest, download, or extract data from Super Minty without written permission;
• Use bots, crawlers, scrapers, automated tools, or data-mining systems without written permission;
• Republish, redistribute, sell, rent, sublicense, or commercially exploit Super Minty data or content;
• Use Super Minty data to build a competing price guide, database, app, website, tool, product, marketplace, or service;
• Reverse engineer, modify, interfere with, or attempt to access the website's source code, systems, databases, or security features;
• Upload or transmit viruses, malware, spyware, worms, or other harmful code;
• Use Super Minty for unlawful, fraudulent, abusive, harassing, defamatory, or harmful purposes;
• Violate the intellectual property, privacy, publicity, or other rights of Super Minty or any third party;
• Misrepresent your identity or affiliation with Super Minty;
• Attempt to disrupt or impair the availability, security, or performance of the Services.

We reserve the right to restrict, suspend, or terminate access to any part of Super Minty if we believe these Terms have been violated.

7. Pricing Data and Market Information

Super Minty provides video game pricing data, sales history, estimated values, format-based averages, confidence indicators, and related information.

This information is provided for informational and educational purposes only.

While we work to collect, organize, and present data in a useful way, we do not guarantee that any price, value, estimate, average, format category, condition interpretation, confidence rating, sales history, or market insight is accurate, complete, current, or error-free.

Video game values may change based on many factors, including format, condition, variant, print run, completeness, grading company, grade, seller reputation, marketplace activity, buyer demand, auction timing, economic conditions, listing quality, photos, descriptions, and broader market trends.

Seller listings and marketplace data may be incomplete, misleading, mislabeled, outdated, or incorrect. Super Minty data should be treated as a helpful guide, not a guaranteed value.

8. Third-Party Marketplace Data

Super Minty may collect, organize, reference, summarize, categorize, or display limited publicly available information from third-party marketplaces, affiliate-linked sources, public sales records, auction platforms, and other external sources.

This information may include limited details such as sale month, sale year, sale price, item format, item category, and links back to the original marketplace or source. Super Minty does not claim ownership over third-party marketplace content.

Third-party marketplace data may be incomplete, inaccurate, outdated, unavailable, mislabeled, or misleading. Seller titles, listing descriptions, photos, condition details, item categories, and marketplace information may contain errors or omissions. Super Minty may interpret, categorize, summarize, exclude, update, or remove third-party marketplace data at any time.

You agree that Super Minty is not responsible for the accuracy, availability, legality, quality, condition, authenticity, pricing, delivery, or fulfillment of any third-party marketplace listing, sale, item, seller, buyer, or transaction.

Third-party marketplace names, trademarks, logos, links, and content remain the property of their respective owners. Unless expressly stated, Super Minty is not affiliated with, endorsed by, sponsored by, or officially approved by any third-party marketplace.

9. No Financial, Investment, or Appraisal Advice

Super Minty does not provide financial, investment, legal, tax, appraisal, grading, or authentication advice.

Nothing on Super Minty should be interpreted as:

• A guarantee of value;
• A promise that an item will sell for a specific amount;
• A recommendation to buy, sell, hold, grade, or invest;
• A professional appraisal;
• Authentication of a game, variant, seal, grade, or condition;
• Financial or investment advice.

You are solely responsible for your own research, decisions, purchases, sales, trades, grading submissions, and financial risk.

Always use your own judgment and review multiple sources before making collector or financial decisions.

10. Format-Based and Condition-Aware Pricing

A core part of Super Minty is format-based and condition-aware pricing.

We may organize data by formats such as loose, complete, sealed, box only, manual only, graded, and other formats or conditions. These categories are based on available data, listing information, internal systems, and our interpretation of marketplace activity.

Because sellers do not always describe games accurately, some items may be categorized incorrectly. A listing title, photo, or description may not clearly identify whether a game is complete, missing a manual, sealed, resealed, damaged, graded, a later print, a specific variant, or otherwise misrepresented.

Super Minty may revise, remove, update, correct, or recalculate data at any time.

11. User Content

Some Super Minty features may allow users to submit, upload, post, comment, message, share, or save content.

This may include collection information, notes, comments, feedback, images, corrections, messages, or other user-submitted material.

You retain ownership of the content you submit. However, by submitting content to Super Minty, you grant us a non-exclusive, worldwide, royalty-free license to host, store, display, reproduce, modify, publish, distribute, and use that content as needed to operate, improve, promote, and provide the Services.

You are responsible for the content you submit.

You agree not to submit content that:

• Is false, misleading, defamatory, abusive, threatening, or harassing;
• Violates another person's rights;
• Infringes copyright, trademark, privacy, publicity, or other legal rights;
• Contains spam, scams, malware, or harmful code;
• Promotes illegal activity;
• Contains private information you do not have permission to share;
• Violates these Terms or any community rules we publish.

We may remove, edit, restrict, or refuse to display user content at our discretion.

12. Public and Community Areas

If Super Minty offers public profiles, comments, forums, Discord spaces, social features, or other community areas, content you share in those areas may be visible to other users or the public.

Please use good judgment before sharing personal information, collection details, transaction details, or anything you do not want others to see.

We are not responsible for user-generated content posted by others. Community discussions, comments, messages, opinions, and claims may be inaccurate, incomplete, offensive, misleading, or harmful.

You should independently verify any information before relying on it.

13. Ownership and Intellectual Property

Super Minty, including its name, logo, branding, design, text, graphics, interface, data organization, pricing systems, software, tools, features, databases, charts, visuals, videos, content, and other materials, is owned by Mynty LLC, doing business as Super Minty, or its licensors.

Using Super Minty does not give you ownership of our website, software, data, trademarks, branding, content, or intellectual property.

You may not copy, reproduce, modify, distribute, sell, sublicense, publicly display, create derivative works from, or commercially exploit Super Minty materials without our written permission.

All rights not expressly granted are reserved.

14. Limited Personal Use of Data

Super Minty is built for collectors to research and understand their collections.

You may use Super Minty data for your own personal collecting, buying, selling, tracking, and research purposes.

You may not use Super Minty data to:

• Create a competing price guide, database, app, website, tool, service, or marketplace;
• Mass-download, scrape, export, or harvest data;
• Resell, redistribute, or commercially license the data;
• Train machine learning models or automated systems without written permission;
• Misrepresent Super Minty data as your own;
• Use the data in a way that harms Super Minty or its users.

15. Third-Party Links and Affiliate Relationships

Super Minty may contain links to third-party websites, marketplaces, auction platforms, retailers, grading companies, social media platforms, videos, posts, or other services.

We do not control third-party websites and are not responsible for their content, policies, accuracy, practices, security, or availability.

When you click a third-party link, you are leaving Super Minty and are subject to that third party's terms and privacy policy.

Some links on Super Minty may be affiliate links. This means we may earn a commission if you click a link and make a purchase or complete a qualifying action. Affiliate relationships may include, but are not limited to, third-party marketplace affiliate programs or similar programs.

Affiliate relationships do not guarantee the accuracy, quality, authenticity, condition, or value of any item listed by a third party.

16. Privacy

Your use of Super Minty is also governed by our Privacy Policy.

Our Privacy Policy explains how we collect, use, store, share, and protect information. Please review it carefully.

17. Service Availability and Changes

Super Minty is provided on an "as-is" and "as available" basis.

We may update, modify, suspend, limit, remove, or discontinue any part of the Services at any time, with or without notice.

We do not guarantee that Super Minty will always be available, uninterrupted, secure, fast, accurate, complete, or error-free.

We may experience downtime, bugs, data errors, missing information, technical issues, delays, maintenance, or other disruptions.

18. Disclaimer of Warranties

To the fullest extent permitted by law, Super Minty and its Services are provided without warranties of any kind, whether express, implied, statutory, or otherwise.

We disclaim all warranties, including warranties of accuracy, completeness, reliability, availability, merchantability, fitness for a particular purpose, title, non-infringement, quiet enjoyment, security, and suitability.

We do not guarantee that:

• The Services will meet your expectations;
• The website will be uninterrupted, secure, or error-free;
• Pricing data will be accurate, current, or complete;
• Format categories or condition interpretations will always be correct;
• Sales history will always reflect the full market;
• Any item will sell for a displayed estimate;
• Any user content or third-party content will be accurate or reliable.

You use Super Minty at your own risk.

19. Limitation of Liability

To the fullest extent permitted by law, Super Minty, Mynty LLC, and their owners, directors, employees, contractors, partners, affiliates, licensors, contributors, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, punitive, or other damages arising from or related to your use of Super Minty.

This includes, but is not limited to:

• Financial loss;
• Business loss;
• Lost profits;
• Lost data;
• Loss of goodwill;
• Incorrect buying or selling decisions;
• Overpaying for an item;
• Underselling an item;
• Relying on incorrect or incomplete data;
• Misidentified variants;
• Format or condition disagreements;
• Third-party marketplace issues;
• User-generated content;
• Service interruptions;
• Unauthorized access;
• Technical errors.

Because Super Minty is currently free to use, to the maximum extent permitted by law, our total liability for any claim arising out of or relating to these Terms or the Services will be limited to one hundred dollars ($100) or the minimum amount required by applicable law, whichever is greater.

20. Indemnification

You agree to defend, indemnify, and hold harmless Super Minty, Mynty LLC, and their owners, directors, employees, contractors, partners, affiliates, licensors, contributors, and agents from and against any claims, liabilities, damages, losses, costs, expenses, or fees, including reasonable attorneys' fees, arising from or related to:

• Your use or misuse of Super Minty;
• Your violation of these Terms;
• Your violation of any law or regulation;
• Your violation of another person's rights;
• Your user content;
• Your use of Super Minty data;
• Your disputes with other users or third parties.

This section survives termination of your account or use of the Services.

21. Legal Complaints and Reputation Abuse

We welcome honest feedback, fair criticism, and good-faith discussion.

However, you may not use Super Minty, our community spaces, or other platforms to knowingly spread false information, impersonate Super Minty, harass our team or users, submit fake reports, abuse review systems, threaten others, or engage in malicious activity intended to harm Super Minty, its users, or its reputation.

Nothing in these Terms limits your right to express truthful opinions, report legitimate concerns, or exercise rights protected by law.

22. Suspension and Termination

We may suspend, restrict, or terminate your account or access to Super Minty at any time if we believe you have violated these Terms, created risk, abused the Services, infringed rights, attempted unauthorized access, scraped data, or acted in a way that harms Super Minty or its users.

You may stop using Super Minty at any time.

Certain sections of these Terms will continue to apply even after your account or access ends, including ownership, data use restrictions, disclaimers, limitation of liability, indemnification, dispute resolution, and other provisions that by their nature should survive.

23. Governing Law and Dispute Resolution

These Terms and any dispute arising from or relating to them or your use of Super Minty will be governed by the laws of the State of California, without regard to conflict of law principles.

Before filing a claim, both parties agree to first attempt to resolve the dispute informally by contacting the other party.

If the dispute cannot be resolved informally, it shall be brought exclusively in the appropriate state or federal courts located in California, unless applicable law requires otherwise.

24. Waiver of Jury Trial

To the fullest extent permitted by law, you and Super Minty waive any right to a trial by jury for any dispute arising out of or relating to these Terms or the Services.

25. Class Action Waiver

To the fullest extent permitted by law, all claims and disputes must be brought on an individual basis only.

You and Super Minty agree not to bring claims as part of a class action, collective action, consolidated action, private attorney general action, or representative proceeding.

Only individual relief is available.

26. Notices

By using Super Minty, you agree that we may communicate with you electronically.

We may provide notices by email, by posting on the website, through your account, or through other reasonable electronic means.

27. Changes to These Terms

We may update or modify these Terms from time to time.

When we do, we will update the "Last Updated" date at the top of this page. If changes are material, we may provide additional notice.

Your continued use of Super Minty after updated Terms are posted means you accept the updated Terms.

28. Miscellaneous

Entire Agreement

These Terms, together with our Privacy Policy, Disclaimer, Community Guidelines, Cookie Policy, and any additional terms we publish, make up the entire agreement between you and Super Minty regarding your use of the Services.

Severability

If any part of these Terms is found to be invalid or unenforceable, the remaining parts will remain in full force and effect.

No Waiver

Our failure to enforce any part of these Terms does not mean we waive our right to enforce it later.

Assignment

You may not assign or transfer your rights or obligations under these Terms without our written permission. We may assign or transfer our rights and obligations as part of a merger, acquisition, sale, restructuring, or other business transaction.

Force Majeure

We are not responsible for delays or failures caused by events outside our reasonable control, including natural disasters, labor disputes, internet failures, service provider outages, cyberattacks, war, terrorism, government actions, power failures, epidemics, or other similar events.
